Waiver and Release

This is a waiver and release of certain legal rights. PLEASE READ IT CAREFULLY.

This page defines responsibilities with respect to all Inroads Travel LLC d/b/a Inroads Ireland’s trips. Payment for an Inroads Ireland trip represents your acceptance of the following Waiver and Release.

Acknowledgement and Assumption of Risk

Each person or person(s) on the reservation, hereafter referred to as the “Client”, for him/herself and on behalf of any minors accompanying Client, acknowledges that the Client has voluntarily applied to participate in one or more tours offered by Inroads Ireland. The Client is voluntarily participating in this trip with the knowledge of the usual risks and inherent dangers involved in group travel including but not limited to: unfamiliar locales; sitting, running, walking, climbing for longer periods than Client may be used to; navigating unfamiliar, narrow, paved/unpaved, steep roads, paths, gangways, and stairs; risks inherent in the maintenance or operation of any bus, van, watercraft, aircraft, train, motorcycle, bicycle, or other vehicle utilized to transport passengers; physical exertion for which the Client is not prepared; forces of nature and extreme weather; transportation failures whether by bus, plane, train, auto, boat, canoe, kayak, bicycle, horseback or other animal, by foot, or by any other conveyance; risks associated with the consumption of alcoholic beverages, food or impure water; civil unrest; terrorism; criminal activity; dangers associated with wild or other animals; breakdown or failure of equipment; high altitude; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided; and stolen, lost, or misplaced luggage or property. In consideration for participating in the tour, Client understands and voluntarily and willingly accepts these risks, including the risks of delay, unanticipated events, inconveniences, illness, injury, emotional trauma or death.

COVID-19

COVID-19 is a contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and individuals with underlying medical conditions are especially vulnerable. Inroads Ireland cannot prevent you (or your child(ren)) from becoming exposed to, contracting, or spreading COVID-19 while participating in a trip, which includes sitting in a bus, visiting indoor and outdoor sites, dining, staying in sleeping accommodations with other participants on the trip and members of the public. The Client acknowledges that there is a risk of transmission of illnesses, including COVID-19, from person-to-person contact and/or by contact with contaminated surfaces and objects and possibly in the air. Client voluntarily and willingly accepts these risks. By choosing to participate on a trip, Client agrees to comply with all health and safety laws and regulations of Ireland and its local communities and the guidelines and instructions established by Inroads Ireland or its guides. Client agrees not to participate in the trip if Client has a temperature higher than 100.4F or is experiencing any symptoms associated with COVID-19, including, but not limited to, fever, cough, unusual fatigue, headache, nausea, or loss of taste or smell, until 24 hours after the symptoms have ceased and a negative COVID-19 test result has been obtained. Client understands that they may be asked to leave the tour in case of illness at Inroads Ireland’s sole discretion, and agrees that no refunds will be provided if a trip is cancelled or curtailed due to Client’s illness.

Consent to Medical Assistance

The Client agrees that if Client suffers injury or illness, Inroads Ireland or its staff can, at Client’s cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for Client’s health and safety. Client agrees to waive liability against and to hold harmless Inroads Ireland for the rendering of any such medical assistance.

Release of Liability

The Client acknowledges that the cost of all Inroads Ireland trips is based upon trip participants executing this Waiver and Release. IN CONSIDERATION FOR MY ABILITY TO PARTICIPATE IN THE TRIP, THE CLIENT HEREBY FOREVER RELEASES AND COVENANTS NOT TO SUE INROADS IRELAND, ITS EMPLOYEES, OWNERS, OFFICERS, STAFF, GUIDES, INSURERS, AND ANY AGENTS OF ANY KIND (COLLECTIVELY KNOWN AS “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY FOR ANY ACT OR OMISSION OF ANY KIND OR CHARACTER, OTHER THAN GROSSLY RECKLESS OR INTENTIONAL CONDUCT OF THE RELEASED PARTIES, ARISING FROM OR OUT OF HIS OR HER PARTICIPATION IN AN INROADS IRELAND TRIP, INCLUDING WITHOUT LIMITATION ALL COSTS, DAMAGES, CLAIMS OR ASSERTIONS OF ANY KIND WITH RESPECT TO WHICH THE CLIENT OR THE CLIENT’S FAMILY, ESTATE, HEIRS, SUCCESSORS OR ASSIGNS MAY CLAIM AGAINST THE RELEASED PARTIES. AGREEMENT TO THIS WAIVER AND RELEASE SIGNIFIES THAT THE CLIENT FULLY ASSUMES ALL THE RISKS ASSOCIATED WITH THIS TRIP AND RELEASES INROADS IRELAND FROM ANY AND ALL LIABILITIES TO THE MAXIMUM EXTENT PERMITTED BY LAW. CLIENT FURTHER AGREES AND ACKNOWLEDGES THAT INROADS IRELAND SHALL NOT BE RESPONSIBLE FOR ANY LOSS, THEFT OR DAMAGE WHATSOEVER TO ANY PERSONAL PROPERTY BROUGHT ONTO THE TOUR BY CLIENT AND THAT DOING SO IS AT CLIENT’S SOLE RISK AND RESPONSIBILITY.

Release of Liability – Third Parties

Inroads Ireland and its employees do not own or operate any entity which provides, or is to provide, goods or services for the Client’s trip including without limitation, lodging, facilities, transportation companies, food service providers and equipment suppliers. AS A RESULT, THE CLIENT AGREES TO FOREVER RELEASE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY FOR INJURY TO THE CLIENT OR DAMAGE TO OR LOSS OF THE CLIENT’S PROPERTY CAUSED BY ANY ACTS OR OMISSIONS OF ANY KIND OR CHARACTER WHATSOEVER OF: HOTELS AND OTHER RESIDENTIAL FACILITIES, COMMON CARRIERS, HEALTH CARE PROVIDERS, RESTAURANTS AND FOOD SERVICE PROVIDERS, OR ANY OTHER THIRD PARTIES RELATED TO OR CONNECTED IN ANY WAY WITH INROADS IRELAND INCLUDING WITHOUT LIMITATION ANY COSTS, DAMAGES, CLAIMS OR ASSERTIONS OF ANY KIND WITH RESPECT TO WHICH THE CLIENT OR HIS OR HER FAMILY, ESTATE, HEIRS, SUCCESSORS OR ASSIGNS MAY CLAIM AGAINST THE RELEASED PARTIES.

Representations

By purchasing the Inroads Ireland trip and checking the box indicating the Client has read and understands this Waiver and Release, the Client is (a) representing and confirming to Inroads Ireland that he or she has the legal capacity to agree to this Waiver and Release with Inroads Ireland; (b) acknowledging that he or she is waiving certain legal rights as a result of agreeing to be bound by this Waiver and Release; and, (c) representing that he or she has read and fully understands each paragraph of this Waiver and Release and has been provided with the opportunity to discuss it with Inroads Ireland and/or anyone else of his or her choosing. The Client further understands and hereby confirms to Inroads Ireland that this is a legally binding agreement and is enforceable by Inroads Ireland against the Client in accordance with the terms hereof.
